Trading Standards departments can investigate and prosecute sole traders as well as private and public companies, covering a wide range of alleged conduct — copyright and trademark infringement, misleading trade descriptions, breaches of consumer credit law, weights and measures offences, and food safety failures, among others.
Investigations typically begin with a complaint from a consumer or a test purchase carried out by a Trading Standards officer, and usually lead to an invitation to attend an interview under caution.
What's said at that interview can significantly affect any later prosecution decision — and in some cases, it's possible to negotiate an alternative to prosecution, such as a formal caution or a written warning, rather than court proceedings.
Consequences on conviction range from a caution or fine through to licence conditions, revocation of a licence to trade, or, in more serious cases, a custodial sentence — which is why getting advice before, not after, the interview matters.
